Terms of Service and Sale

1. Scope and provider

These terms apply to the use of Extraits Pod and to the contracts concluded on this website (Creator, Pro and Agency subscriptions, 1-video Pack). The service is provided by [to be completed], [to be completed], [to be completed] (full details in the legal notice).

2. Service

Extraits Pod is a personal tool that cuts videos into short clips and publishes those clips to its user's own accounts (YouTube, Instagram, TikTok) through these platforms' official APIs. What each plan includes (in particular the number of videos and clips per month) is as described on the home page at the time of the order.

Publishing. Nothing is published without an explicit action or setting by the user (publish button, or automatic publishing enabled by them). On TikTok, videos are sent according to the permissions the user granted to the app.

3. Ordering and conclusion of the contract

To order, the user chooses a plan and billing period (or the 1-video Pack), ticks the box requesting that the service start right away (section 8), then clicks the plan's button. They are taken to Stripe's secure checkout page, where they enter their details and payment method and accept these terms. Until the final click on the payment button, they can correct their details or abandon the order. The contract is concluded when the payment is confirmed: the user then reaches the confirmation page and receives a receipt by email.

The contract can be concluded in French, German, Italian or English. The order details are stored with Stripe and appear on the receipt; these terms can be viewed, printed and saved on this page at any time.

4. Prices and payment

Plans and prices. The plans (Creator, Pro, Agency) and the 1-video Pack are described on the home page. All of them are paid offers, with prices in euros including VAT, payable through Stripe.

Payment. Payments are processed by Stripe (card, Apple Pay, Google Pay, PayPal, SEPA Direct Debit and other methods offered depending on the country). Extraits Pod never stores any bank or card details.

Billing. The monthly subscription is paid in advance each month, the yearly subscription in advance for twelve months (2 months free), and the 1-video Pack once, when ordering.

5. Term, renewal and cancellation

Subscription. Monthly and yearly subscriptions renew automatically at the end of each period (each month or each year), with no minimum term beyond the current period. They can be canceled at any time and remain active until the end of the period already paid, which is not refunded pro rata, subject to the mandatory rules that protect consumers in their country of residence (for example after a yearly subscription has renewed). For the yearly subscription, the user is informed by email, no earlier than three months and no later than one month before the renewal date, of the option not to renew it.

How to cancel. Without logging in, with the “Cancel contracts here” button (page Cancel your subscription), which immediately issues a dated acknowledgement of receipt; under “Manage my subscription”; or by email. Termination for cause remains possible as provided by law. The 1-video Pack is a one-time purchase and needs no cancellation.

6. Loyalty pricing

On the monthly subscription, a discount is applied automatically to renewal invoices: 10% off from month 4, 20% off from month 7 and 30% off from month 13 of the current subscription. A new subscription after cancellation starts again at the full price. The yearly subscription comes with 2 months free instead.

7. 1-video Pack

One-time purchase covering the processing of one video (up to 5 clips), with no subscription.

8. Right of withdrawal

Right of withdrawal. Consumers have a 14-day right of withdrawal from the day of purchase. The service is provided as soon as the customer area is made available. Before payment, a separate checkbox, never ticked in advance, lets the customer expressly request that the service start right away, before that period ends, and acknowledge losing the right of withdrawal once the service has been fully performed (Article L221-28 of the French Consumer Code); accepting these terms does not, on its own, amount to that request. The request and acknowledgement are confirmed to the customer by email, on the receipt or invoice. Without this express request, the 14-day right of withdrawal applies in full. A refund requested within 14 days of purchase, before any video has been processed, is accepted.

To withdraw, the customer uses the “Withdraw from contract here” button (page Withdrawal, which also contains the full information on the right of withdrawal and the model withdrawal form) or sends us an unequivocal statement by email or by post. If they asked for the service to start during the withdrawal period, they owe us an amount proportionate to the service provided until their withdrawal.

9. User responsibilities

The user keeps all rights to their videos and clips; they only allow us to store, process and publish them at their request, to the extent needed to provide the service.

10. Availability and statutory rights

We do what is needed to keep the service available but cannot guarantee uninterrupted availability: it depends on third-party services (video platforms and their APIs) and their possible restrictions. The statutory guarantees of conformity for digital content and services apply.

12. Complaints and mediation

Complaints can be sent to the contact below. In the event of a dispute, consumers can refer the matter free of charge to a consumer mediator: [to be completed] — [to be completed], after first trying to settle the dispute directly with us through a written complaint.

13. Governing law and languages

These terms are governed by French law. Consumers keep the protection granted to them by the mandatory provisions of the law of their country of residence and may bring proceedings before the courts of that country. These terms exist in French, German, Italian and English; each language version is equally authentic.
